Your consent to, compliance with, and passing of such exam and testing, if applicable, is a condition of employment; and continued employment is based on the successful passing of such testing. You release Scoular and its designee from any and all liability and damages that may result or arise from any exam or test, or the provision of information in connection with such an exam or test.

The disclosure of criminal or dishonest conduct on this application will not necessarily result in your disqualification from employment.

  1. Illinois, Minnesota, Massachusetts, New Jersey, Rhode Island and Hawaii applicants. Do not answer any Public Records questions.
  2. All other applicants: Do not include convictions that were by court order sealed (including Juvenile records), restricted, eradicated, erased, annulled, expunged, dropped, dismissed, discharged, pardoned, or charges that resulted in acquittal or a diversion program successfully completed or currently in progress, or charges that resulted in a suspended imposition of sentencing after which the court discharged or dismissed the charge.

  4. California applicants: Do not include misdemeanor marijuana-related convictions that are more than two (2) years old or misdemeanor convictions for which probation was successfully completed or otherwise discharged and the case was judicially dismissed.
  5. Connecticut applicants: You are not required to disclose the existence of any arrest, criminal charge, or conviction, the records of which have been erased. Criminal records subject to erasure are records pertaining to a finding of delinquency or the fact that the child was a member of a family with service needs, an adjudication as a youthful offender, a criminal charge that has been dismissed or nolled (not prosecuted), a criminal charge for which the person was found not guilty, or a conviction for which the offender received an absolute pardon. Any person whose criminal records have been erased is deemed to have never been arrested within the meaning of the law as it applies to the particular proceedings that have been erased, and may so swear under oath.
  6. District of Columbia and Washington applicants: Limit your responses to the past ten (10) years.
  7. Indiana applicants: Regarding charges/arrests, limit your response to pending charges for felonies and class A misdemeanors that are less than one (1) year old.
  8. Michigan applicants: Regarding charges/arrests, limit your response to felony arrests awaiting conviction or dismissal.

You should not answer these PUBLIC RECORDS questions if you are residing in or seeking a position in the States of Illinois, Minnesota, Massachusetts, New Jersey, Rhode Island, or Hawaii. All other applicants should answer the questions after reviewing the specific instructions below. The disclosure of a criminal record will not automatically bar employment. Decisions will be based on an individualized assessment, including the nature and gravity of the offense, the time passed since the offense, and the nature of the job sought.

Have you since your 18th birthday ever been convicted or pled guilty to any felony? (Additionally, include any convictions or guilty pleas not sealed by court order).
